Are pets considered property in a New York divorce?
Pets are an important part of many families, including my own, and they are certainly a significant consideration during a divorce. I’ve mediated numerous cases involving dogs, cats, and the question of who will take care of them. That being said, courts, by law, are required to view pets as property—like couches, chairs, jewelry, or automobiles—and can award them to one person or the other.
Given this, it’s wise to keep your pets out of court proceedings. Instead, treat them as beloved family members and do them the favor of creating a plan that works for them, rather than leaving the decision to the courts.
