Will Mediation Work for Me?

Many people ask me whether mediation will work for them and how they can maximize its effectiveness. I’m Katherine Miller, and I’ve been a divorce attorney and mediator in New York City and New York State for over 30 years. Based on my experience, here are a few key strategies to enhance the likelihood of a successful mediation:

  1. Approach Mediation as a Problem Solver: Focus on finding solutions together, rather than proving the other party wrong. Even if you’re convinced you’re right, understanding and considering the other person’s perspective is crucial for reaching a resolution. Think of mediation as a collaborative process aimed at solving a problem, not a battle to win.
  2. Be Respectful: Treat the other party, the mediator, and the mediation process with respect. Be cordial and courteous, do your homework, and stay focused on the task at hand. Respectful behavior fosters a more productive and amicable environment.
  3. Keep Your Emotions in Check: Managing your emotions can be challenging, especially in high-stress situations like mediation. I understand how difficult it can be, as I experienced it myself during my own divorce. However, working through your feelings outside of the mediation room can help you stay calm, respectful, and in control during the process.
