Nine out of ten mental health professionals recommend avoiding litigation for clients facing divorce. I’m Katherine Miller, and with over 30 years of experience as a divorce attorney, I can tell you that the benefits of staying out of court far outweigh the perceived advantages of going to court.

In my experience, people often end up in court for one of two reasons:

  1. Lack of Awareness: They simply don’t know that there are alternative options like mediation, collaborative law, and out-of-court negotiations. These methods can help resolve issues without involving a judge.
  2. Feeling Stuck: They can’t imagine reaching an agreement with someone they’ve been in conflict with, whether it’s been for years, months, or even weeks. It feels so entrenched that they believe only a judge can make a final decision.

However, staying in control of your life and making decisions yourself, rather than relying on a stranger in a black robe, is much better. It’s not just emotionally beneficial—it’s also more financially advantageous and allows you to create a resolution that truly works for you, your children, and even your soon-to-be ex-spouse.
