If you have legal counsel, they usually provide advice outside the mediation sessions. Mediation is a great option for many, but it may not be suitable for everyone.
2. Collaborative Law: Collaborative law is another alternative. In this model, attorneys are present throughout the process, but they are disqualified from litigating, which ensures that everyone is fully invested in reaching a settlement without going to court. Collaborative law often involves an interdisciplinary approach, bringing in financial specialists and mental health professionals to address various aspects of the divorce.
3. Mediation with Attorneys Present: A less commonly known option is mediation with attorneys present. This combines the benefits of mediation with the support of having your lawyer in the room. Unlike collaborative law, it doesn’t require specialized training or agreements to avoid litigation but still allows for legal guidance during mediation.
