People who should consider a Prenup

As we near the end of a very difficult 2020, and as I record this, there’s snow on the ground, making it hard to imagine that spring will come—but it will. And with spring comes wedding season. Today, I want to talk about who needs a prenuptial agreement and why. I’m Katherine Miller, and I’ve been a family attorney in New York City, New York State, and Westchester County for over 30 years. Here’s what I’ve learned from working with couples who are getting married and considering prenuptial agreements.
The first group of people who should consider a prenup are those who come from wealthy families. These are often individuals getting married for the first time, and their families may want them to have a prenup to protect their family’s assets. There’s often concern that the marriage could end in divorce, putting the family wealth at risk. So, young people from wealthy families may need a prenup to safeguard inheritances and family assets.
The second group are people getting married later in life who have already built up some wealth or started a business. They may have personal assets they want to protect in the event of a divorce—or even if the marriage ends by death. For this group, a prenuptial agreement can help ensure that their assets remain secure.
The third group includes individuals who have been married before or have children from a previous relationship. These individuals often want to ensure that their children are protected when this new marriage comes to an end, either through divorce or death.
It’s important to understand that all marriages come to an end—either through divorce or death. While divorce is usually the primary reason people think about a prenup, it’s just as critical to consider what happens when a marriage ends due to the death of a spouse after a long and happy relationship.
