While it’s freezing today as I record this video, I promise that spring is on its way—and with it comes wedding season. For those of us working in family law, that means it’s prenup season.

I’m Katherine Miller, and I’ve been assisting clients with prenups and divorces for over 30 years. I’ve guided countless individuals through the process of drafting prenuptial agreements, whether they’re needed, what they entail, and how to handle them smoothly.

So, what exactly is a prenup? A prenuptial agreement outlines how assets and responsibilities will be managed in the event of a marriage ending, whether through divorce or death. It’s essential to consider these aspects as they form the basis of the prenup negotiations.

But let me ask you: Why are you getting married? It’s crucial to think about your goals for the marriage before you get caught up in details like flower colors or guest lists. Consider what you want to achieve together and how to support those goals. How will you handle expenses and cash flow? Will you have a joint account, and if so, how will contributions be managed? What type of partnership are you aiming to build—financial, romantic, parenting, or all three? Understanding how these elements fit together is vital.

You should also consider how you’ll approach these discussions. Will you use mediation to facilitate the conversation, or will you each hire your own lawyer? There are several ways to handle this, and the approach you choose will influence the process.
